Stowe Family Law Senior Associates Siobhan Vegh, and Natalie Nero and Solicitor Rebecca Sutton instructed Barrister Philip Perrins of 1GC Family in a divorce and financial remedies case, representing the applicant Wife.
The judgment has been reported on this difficult financial case which involved several complicating factors including alleged historical loans from the parties’ parents (and an intervention from Husband’s mother); inheritance received by H during the marriage; businesses interests including third party; property valuation disputes; H’s non-disclosure and refusal to cooperate.
The parties had four children, three minors at the date of the final hearing. This was a needs case, and although there appeared to be multiple assets, there was minimal liquid capital to rehouse the parties and the dependent children.
Judge found H’s evidence ‘far removed from the truth’. Lack of authentic disclosure meant that it was difficult for the court to determine the full value of businesses.
W was awarded entry to the family home, pending being put on the market. H will receive £100,000 from net proceeds, and W will receive the remainder, coming to a split of 75.76% to W and 24.4% to H. Each party retained their business interests, excepting transfer of W’s interest in a property company to H.
H was submitted to a costs order of £20,000.
